Legacy Hotels and Castleburn Timeshare
Corrupt and dodgy timeshare practices by Castleburn and Legacy Hotels
- Castleburn or Legacy Hotels did not attempt to sell the timeshare as per below industry practices.
- Castleburn creates false debt on the books of outstanding levies and conjures up all sorts of false penalties and admin costs.
- In the car and home industry it is termed an easy sell option…. you don’t pay your car payments the car is sold on your behalf. Yet Legacy Hotels and Castleburn are not selling the timeshares and running up 3 years of false outstanding levies and other illegal fees added on instead of selling the timeshare in the first year.
- Refusal to take back ownership for free when levy is up to date
- Refusal to sell timeshare on behalf of owner when levy is up to date
- Refusal to sell timeshare on behalf owner when level is not up to date
- Refusal to taek back ownership when levy is not up to date
- After running up 3 years of levy debt, happy to sell to current timeshare owners for free as long as they pay the transfer cost and levy for the next year up front. (or current years levy but cannot use the timeshare that year)
- Castleburn is selling the timeshare, to timeshare related companies to use them to sell points against this timeshare weeks.
- They rent the timeshare out but never crediting the owner account.
- They are renting the timeshare out to foreign tourists and never crediting that money to the owners account or
- When people phone to rent saying they are fully booked instead of renting the timeshare out.
- Not letting the owner sell the timeshare without paying the levy first. Owner is being blackmailed and not able to sell their timeshare. Delay tactic to try and run up more costs and false admin fees while the above is accomplished.
- Runing up debt to be able to take over the timeshare for basically to free rent it out to foreign tourists
- Selling timeshare to sister companies and other family and friends related companies.
- Levies are being pushed up by the majority owners to for South Africans to sell their timeshare.

Rules below which are not being applied by Castleburn and Legacy Hotels
Balance sheet is showing false debt of 3 years levies
Levy debt over three years is being illegally debt collected on and owners threatened of legal action when it is prescribed. Debt past 3 years is prescribed and may not be legally collected on.
Levies for the last 15 years needs to be listed with the % increase and a reason for any anomalies.
Timeshare Industry Standards & Rules for unpaid timeshare levy:
- Timeshare cannot be used by the owner if levy is unpaid.
- Flexi timeshare if not paid by 1 January can be sold by timeshare resort.
- Flexi timeshare if not paid by 1 January can be rented by the timeshare resort and credited to the levy account.
- Set date timeshare levy (i.e. not flexi) if not paid 3 months before date of use can be sold by timeshare resort.
- Set date timeshare levy if not paid 3 months before use, can be rented by the timeshare resort and credited to the levy account.
- Timeshare resort maximum rental fee (including admin fees) or sales fee (including admin) admin fee of R1500 or 15% whichever is higher.
- Any timeshare sold will be credited to the levy account and the difference paid to the previous owner. If there is a deficit the amount owing is then still owed by the previous owner.
- Owner may sell timeshare and transaction handled by resort whereby money is paid into levy account.

- If timeshare levy remains unpaid 2 months after due date the timeshare it may be auctioned on an official online timeshare site with a minimum value of the outstanding levy.
- Where more than a total 12 full weeks are owned by a single person / company / trust or entity are to be listed on the timeshare resort website, entity name and number of weeks to be listed and percentage (%) of total weeks. In the case of a person surname and number of weeks to be listed. This is to be listed from highest to lowest in a spreadsheet format.
